Description

Our OISC level 2 course runs over two days and consists of more complex casework (i.e. applications outside of the Immigration Rules). In this course we cover the syllabus at OISC level 3. This course is specifically aimed at immigration advisers seeking accreditation at OISC Level 3 and may be more suitable to those who are interested in becoming acquainted with immigration and asylum law.

This three-day course is tailored to less experienced practitioners preparing to accredit at a level 3. This is an intensive course and the trainers will still need to move at a fairly intensive pace to cover all the necessary ground..

  • the structure and sources of immigration law, including the framework of the immigration legislation
  • the procedure for making applications under the immigration rules
  • the structure and operation of the immigration rules
  • the appropriate application forms, fees and supporting documentation
  • The key UKVI concessionary policies and how to make out of time and discretionary applications.
  • the personnel and terminology relating to immigration law
  • The types of immigration decision that may be made in an individual’s case dependent upon the stage of the entry or expulsion process that they have reached
  • Leading cases relating to the application and interpretation of immigration law by the courts
  • the requirements of the Refugee Convention and the principle Articles of the ECHR
  • the procedure for making an asylum application and managing those within the system
  • consequences of a grant of refugee status
  • Articles 2 and 3 of the ECHR
  • Article 8 of the ECHR
  • consequences of grant of leave to remain
  • leading cases relating to the interpretation of the ECHR and subsidiary protection
  • the processes for naturalisation/registration

  • The structure and remedies available in the Tribunal
  • The time limits for appealing
  • The legislative provisions in relation to whether there is a right of appeal and what grounds of appeal might be appropriate
  • The procedures and practice before the IAC
  • The remedies available before the High Court
  • the circumstances in which detention is thought justified by the immigration authorities and the factors to be taken into account in determining whether detention is the right course of action
  • The main provisions relating to bail/temporary
  • the remedies before the Upper Tribunal/High Court
  • The major offences under the immigration legislation
  • Awareness of the main provisions relating to benefits/support for persons subject to immigration control
  • the circumstances in which employment is prohibited for persons subject to immigration control
